नर्मदा किनाऱ्यावरची गाणारी शाळा

माझी आणि भारतीची नेमकी ओळख कधी झाली ते आता नक्की आठवत नाही. भारती म्हणजे भारती ठाकूर. नर्मदा परिक्रमेवरचे  नर्मदा परिक्रमा – एक अंतर्यात्रा  ’  हे तिचे पुस्तक आहे. भारती, उषाताई पागे आणि निवेदिता म्हणुन त्यांची एक मैत्रीण – अशा तिघींनीच संपूर्ण नर्मदा परिक्रमा चार-सहा महिने चालुन केली होती. त्यावरचे तिचे हे अत्यंत साधे-सरळ आणि प्रांजळ वर्णन आहे. एवढी परिक्रमा केली म्हणुन कुठलाही दंभ नाही, की अभिनिवेश नाही. भारतीइतकेच नितळ-आरसपानी असे तिचे हे नर्मदेकाठचे प्रवासवर्णन. पण हे पुस्तक वगैरे नंतरचे. माझी तिच्याशी झालेली ओळख ही त्याआधीची. बहुधा माझा कुठलासा लेख लोकसत्तात वाचून तिने मला शोधून काढून फोन केला होता. मी तुमचे लेख आवर्जुन वाचते. छान लिहिता. नेहमीच तुमच्या लेखांची वाट बघत असते. वगैरे. हे देखील तसे नित्याचे. कुणी खूप मनापासून फोन करतात. आवडल्याचे आवर्जुन सांगतात, आपणही ते ऐकतो, क्षणभर सुखावतो, पण दिवसभराच्या धकाधकीत ते मागे पडते. ती ओळख तेवढ्यावरच विरुन देखील जाते. पण अशी क्षणिक ओळख होऊनही काही नाती दृढ होतात, तसे भारतीच्या बाबतीत घडले. 

मागच्या महिन्यात भारतीकडे गेले होते तर माझ्याच लक्षात आले की मध्यप्रदेशात मंडलेश्वरजवळील लेपा गाव माझ्या नेहमीच्या वाटेवर नसूनही मी एव्हाना तब्बल पाच वेळा लेपाला जाऊन आले आहे. मधली सहा वर्ष मी स्वत: मध्यप्रदेशात, भोपाळला रहायला होते. मलाही कामानिमित्त मध्यप्रदेशात खोलवर गावा-गावात जाण्याचा योग आला. त्यातच भारतीशी प्रत्यक्ष भेट झाली. तिचे काम पाहिले. नियमित फोन नसतो, पण आता भारतीशी झालेली ओळख खंबीर पायावर उभी आहे. मध्ये कितीही काळ गेला तरी फोन करताच पुन्हा त्या क्षणापासून मधला काळ सांधला जातो.

भारती ठाकूर कोण आणि तिची ओळख मी का करुन देत आहे असा प्रश्न एव्हाना मनात आलाही असेल. तर भारती मुळची नाशिकची, नर्मदा परिक्रमा करता करता महेश्वरपाशी आली. परिक्रमेदरम्यान नर्मदाप्रकल्पामुळे विस्थापित झालेली गावे तिला दिसत होतीच. अशाच कुठल्याशा  गावात शाळा सुरु करण्याचा ध्यास तिच्या मनाने घेतला. नाशिकमधले सुखवस्तू जीवन सोडून, भरभक्कम पगाराची नोकरी सोडून काट्याकुट्यात, नर्मदेकाठच्या लोकांच्या मुलांना शिकवण्यासाठी ती, नाशिक आणि तिची माणसे सोडून महेश्वरनजिक आली. परक्या गावात, परक्या लोकांत राहिली. त्यांना विश्र्वास दिला, मुलांना शिकवण्याचे व्रत घेतल्यासारखे पायपीट केली. 

आज गावागावातल्या शाळांत मिळुन तिच्यापाशी चौदाशे मुले शिकत आहेत. शिक्षक आहेत. लेपा गावात तिच्या नर्मदालय संस्थेची दुमजली वास्तु आहे, पसारा वाढला आहे. वाढत आहे. तिने गावात शाळा काढावी म्हणुन आग्रहाने गावकरी तिला बोलवत असतात. शाळेपासून दूर पळणारी मुले शाळेकडे धावत येतात. आणि हो, तिच्या शाळांचे वैशिष्ट्य म्हणजे तिच्या शाळांमधली मुले शाळेत यायला निघाली, चौकात एकमेकांना भेटली की गायला लागतात, वाटेवर गातात, त्यांना घेऊन जाणा-या बसची वाट पहाताना गातात, बसमध्ये गातात, शाळेत पोचली की गातात आणि शाळेतून घरी परत जाईपर्यंत गातच रहातात. भारती सांगते की इतर शाळांमधून जेव्हा मुले रडत रडत शाळेत जातात तेंव्हा आमच्या शाळेतली मुले गात गात जातात. पुन्हा सगळेच गात असल्यामुळे नविन येणा-या मुलाला तसा रडायला वाव मिळत नाही. 

भारतीच्या या शाळाही दिवसभरात केवळ काही तासाच्या, त्यानंतर मुले आपापल्या कामाला जाऊ शकतात. मुलं गुरं चरायला गुरांच्या पाठी जातात, घरात आपल्या भावंडांची पाठराखण करतात, शेतात आई-वडिलांसोबत जातात, शाळा नसती तर जे काही त्यांनी दिवसभरात केले असते ते सर्व काही करतात. दिवसभराच्या कामाला मुलेही हातभार लावत असल्यामुळे पालकांचीही तक्रार नाही, मुलेही शाळेत डांबून रहात नाही. गणवेशाची सक्ती नाही. कारण युनिफॉर्म वगैरेचे चोचले कोणालाच परवडण्यासारखे नसतात.

आपल्या काही शहरी कल्पना असतात. एकतर अलिकडे एक आणि दोन मुलांच्या मर्यादित कुटुंबामुळे आपण मुलांचे लहानपण खूपच लांबवले आहे. मुलांच्या शिक्षणासाठी आई-बापांनी वाटेल ते कष्ट करावेत, प्रचंड पैसे उभे करावेत. मुलांना शिकवावे, परदेशी धाडावे, लग्न करुन द्यावे. त्यानंतरही होता होईल तेवढे परदेशी फे-या मारुन त्यांच्या मागे उभे राहावे, थोडक्यात आपल्याला जी ओढाताण करावी लागली ती आपल्या मुलांना करावी लागू नये अशी आताच्या रिटायरमेंटला पोचणा-या पिढीची मानसिकता आहे. ऐंशी-नव्वदच्या दशकात शिक्षण-लग्न ही ज्याची त्याची जबाबदारी होती. ती जबाबदारी आई-वडिलांची नव्हती आता मात्र ती आई-वडिलांची जबाबदारी झाली आहे. आणि ह्याला मुले नाही तर आई-वडिलच जबाबदार आहेत. सहाजिकच त्यामुळे लहान वयात, आपल्या तर सोडाच, पण इतरही  कुठल्या मुलांनी काम करणे आपल्याला नैतिक दृष्ट्या साफ नामंजुर असते. 

ह्याच विचाराला सुरुंग लावत भारतीच्या शाळांमधून येणारी मुले दिवसभर शाळांमधुन डांबली जात नाहीत. काही तास ती शिकतात आणि मग आपापल्या कामाला निघून जातात, जे काम त्यांच्या कुटुंबाच्या उदरनिर्वाहासाठी आवश्यक आहे त्या कामाला ती लागतात. कारण गरीब कुटुंबात प्रत्येकाने उदरनिर्वाहासाठी कष्ट करणे आवश्यक असते. मुलांना शाळेच्या वाटेला लावायचे म्हणजे त्याचे काम बंद ही त्या लोकांच्या दृष्टीने चैन आहे जी गरीब कुटुंबाला परवडणारी नसते. एकेकदा सत्य स्विकारण्यासाठी मोठीच मोडतोड करावी लागते.

शिक्षणाने आपण नेमके काय साधतो ? आजवर शिकलेले किती आणि कुठले विषय आपल्या पुढल्या आयुष्याला उपयोगी ठरले आहेत ? मुळात शिक्षण म्हणजे मुलाने नेमके काय शिकायला हवे ? एकाच प्रकारचे सरधोपट शिक्षण प्रत्येक मुलाला देणे आवश्यक आहे का ? त्यामुळे तो जगायला लायक होतो का? शहरातून उच्चवर्गिय मुले शिकतात तेच शिक्षण गावागातल्या मुलांना देणे योग्य आहे का? शिक्षण ग्रहण करण्यात मुलांच्या पोषणाचा, मेंदूच्या विकासाचा थेट संबंध असतो त्यामुळे जे विषय शहरी उच्चवर्गिय मुले ग्रहण करु शकतात ते गावाकडची आर्थिक निम्नस्तरिय मुले ग्रहण करु शकतील का? दहावी-बारावी बोर्डाच्या एकाच धारेतून घालवताना जर मुले कॉपी करुन पास होण्याचा मार्ग स्विकारत असतील तर चुक फक्त मुलांची आहे की राबविलेल्या शिक्षणव्यवस्थेची? शिक्षणपद्धतीचा उभा-आडवा छेद घेत आपल्या शिक्षणपद्धतीत आमुलाग्र बदल करायला हवा आहे का? विशेषत: ग्रामीण भारताला आपल्या अर्थव्यवस्थेशी जोडून घ्यायला आपल्या साचेबंद शिक्षण पद्धतीत बदल करायला हवा आहे का ? बेरोजगारी आणि भरताड शिक्षण हे परस्पर पूरक आहेत, हे कळणे आणि त्यात बदल घडविणे हे जरुरीचे नाही का?   

भारतीच्या शाळांमधली सर्व मुले रोज घरी जातात पण काही जण, ज्यांची इच्छा असेल अशी काही मुले, भारतीच्याकडे लेपाच्या घरात रहात आली आहेत. मुलभूत शिक्षण तर त्यांनाही दिले गेले पण त्या नंतर ह्या मुलांनी व्यवसायभिमुख शिक्षण घेतले. दहावी-बारावीची परिक्षा पास झालेच पाहिजे हा निर्बंध नाही. 

लेपाला भारतीच्या घरी त्या रात्री आम्ही मुलांबरोबर बोलत होतो. होळीच्या दिवसातली छान चंद्राची रात्र. मुलं आमच्याभोवती गोलाकार बसलेली. निशिगंध-मधुमालतीचा सुवास हवेत दरवळत होता. जागा तशी निर्जन पण भीतीदायक नाही. आपण इथे लेपाच्या घरी कसे आलो ते प्रत्येक मुलगा सांगत होता. प्रत्येकाची चित्तरकथा. मुलांमध्ये कुणी घर बांधण्यात प्रविण होते तर कुणी इलेक्ट्रिशियनचे काम करण्यात वाकबगार. कुणी घरातले सर्व सुतारकाम केलेले तर कुणी वेल्डिंगचे काम करुन दिलेले. एवढेच काय, अजय नावाचा एक लहानसर चणीचा मुलगा रहातो तिच्याकडे. भारतीच्या गोशाळेचे सगळे काम, म्हणजे गर्भार गाईची सुटका करण्यापर्यंत सगळे काम अजय एकटा मेहनतीने करतो. 

मनात आले, काय गरज आहे या मुलांना बारावीच्या परिक्षेची? अजय खरंतर उत्तम पशुवैद्य होईल पण पुन्हा त्या शिक्षणासाठी आपल्या मार्गात दहावी-बारावी-नेट-सेट-जेटचे अडसर आहेत. माणसाचा कल महत्वाचा नसतोच. शंकरचे गणित उत्तम आहे, गोलु सगळ्यात वाकबगार आहे. स्वैपाक करण्यापासून आर्थिक व्यवहार पाहण्यापर्यंत भारतीचा डोलारा सांभाळण्यात दिग्विजय भैय्याप्रमाणे त्याचाही महत्वाचा वाटा आहे असे ती कौतुकाने सांगते. मुळात मध्यप्रदेशची माणसे आक्रमक, आक्रस्ताळी नाहीत. सौम्य, मनमिळावु, अतिथ्यशील. त्यातून नर्मदेकाठी राहणारी तर परिक्रमावासियांच्या स्वागताला नेहमीच उत्सुक. आमच्या भोवताली बसलेली ती सर्व मुले इतकी आदबशीर आणि जबाबदार की त्यांचा भूतकाळ आणि वर्तमानकाळ यांचा ताळमेळ घालु लागलो तर चक्रावून जावे. 

भारतीकडे भावना-शिवानी-ट्विंकल-पूजा अशी दहा-बारा वयाच्या मुलींची चौकड आहे. घरातल्या मुलांपेक्षा या मुली सगळ्या लहान आहेत पण एकेकीचे गळे असे गोड की ऐकत रहावे. गाणे भारतीतच आहे त्यामुळे मला वाटते ते सगळ्यांमध्ये उतरले आहे. असावा सुंदर चॉकलेटचा बंगला पासुन नर्मदास्तोत्र ते गीतेच्या अठराव्या अध्यायापर्यंत सगळे त्यांना पाठ. हं, सुरु, म्हंटले की कुठेही सुरु होतात. ड्रमवर शिवानी, पेटीवर भावना आणि तबल्यावर त्यांचा दिग्विजय भैय्या. ह्या मुलींचे, त्यांच्या आईचे हाडुस-तुडुस होणारे पूर्वआयुष्य आणि आताचे सरस्वती जिभेवर नांदणारे आयुष्य याला नेमके काय म्हणावे ? भाग्य, नियती, प्रारब्ध की अजुन काही? म्हटलं तर या सगळ्याला शब्द आहेत, म्हंटलं तर आयुष्य एक वाहती नदी. 

भारतीकडेही इथल्या अनुभवांचे भांडार. उग्र रुपाच्या तलवारधारी साधुने तिला आपल्या आश्रमाची जागा कशी दिली, नको असलेल्या गोशाळेची जबाबदारी तिच्याकडे कशी आली ते अगदी अलिकडे भट्यानच्या शाळेपर्यंतचा तिचा सगळाच प्रवास तिच्याच तोंडून ऐकावा असा.

होळीच्या सुमारास चार दिवसांच्या सुट्टीत खास नर्मदेला भेटायला आणि अनुषंगाने भारतीलाही भेटायला महेश्वर-मंडलेश्र्वरला जाणे झाले. लेपाला माझ्या यापूर्वीदेखील फे-या झाल्या होत्या ख-या ,पण भारतीकडे रहायला अशी मी प्रथमच गेले होते. महेश्वरला घाटावर होतो की भारतीचा फोन आला, येताच आहात तर चार-साडेचारपर्यंतच पोचा. म्हणजे दिवसाउजेडी भट्यानची शाळा बघता येईल. ती जागाही खूप छान आहे. तुम्हाला नक्की आवडेल. महेश्वर गाव तसे यथा-तथाच पण अहिल्याबाईंचे घाट आणि नर्मदा म्हणजे जणु विटक्या सुती साडीला भरर्जरी महेश्र्वरी मुलायम पदर. घाटावरुन पाय निघत नाही आणि नर्मदा बघुन मन भरत नाही. भारतीच्या सांगण्यामुळे घाटावरुन लौकरच निघालो. लेपाचा रस्ता नेहमीप्रमाणे चुकत-विचारत तिच्याकडे येऊन पोचलो. गोलु-शंकर, दिग्विजय सगळे अगत्याने भेटले. आम्ही लगेचच भट्यानला पोचलो. 

महेश्वर समोर ठेवून पलिकडच्या तिरावर, जरा उंचावर अशी ही भारतीची भट्यानची शाळा. गावातून आमची गाडी जाताना गावातली सगळी मुलं भरारा आमच्यासोबत शाळेपाशी पोचली. भावना-शिवानी-माधव-ट्विंकल ही सगळी लेपाची बच्चेकंपनी आमच्या बरोबर होतीच. 

भट्यानच्या शाळेशेजारी कुणी एक भुतानचा साधु कुटी बांधुन रहातो. भारतीच्या शाळेच्या प्रवाहात आता तोही सामील झालेला आहे. खूप वर्षांपूर्वी भुतानवरुन निघून जागा शोधत शोधत नर्मदेच्या काठी भट्यानला आला आणि स्थायिक झाला. भट्यानचे गावकरी दिवसभर शेती करतात, नावाड्याचे काम करतात, मोलमजुरी करतात आणि संध्याकाळ झाली की साधुबाबांकडून वेदांत शिकतात. सगळेच अद्भुत. काहीतरी बोलता बोलता साधु बाबा म्हणाले, शिवता शिवता कापड आणि सुई-धागा बाजुला ठेवून उठावे आणि परत येऊन पुन्हा सुई-धागा उचलुन त्याच टाक्यावरुन पुढे टाके घालणे सुरु करावे असा हा जन्म-मृत्यूचा आपला प्रवाह.  

भट्यान, तिथली मुलं, साधुबाबा, नावाडी आणि वेदांत... नर्मदेच्या पाण्यावर सुर्यास्ताचे रंग ! 

नर्मदा ही एक विलक्षण नदी आहे. जो तिच्यापाशी येतो. तो तिच्यात गुंतला नाही असे होत नाही. प्रत्येकाची श्रद्धा नदीपाशी. महाराष्ट्रातल्या नाशिकमधुन येऊन नर्मदा परिक्रमा करता करता नर्मदेच्या विस्थापित गावातल्या निम्नस्तरिय लोकांच्या मुलांसाठी एकटीच्या हिम्मतीवर शाळा चालवणारी भारती खरंच कौतुकास्पद ठरते. 

महाराष्ट्रात तर जागोजाग अशी काम खूपजणं करत आहेत. त्याची माहितीही लोकांपर्यंत पोचते. लेपामधुन निघता निघता भारतीच्या नर्मदालय संस्थेला काय सहयोग देता येईल याचा माझ्या मनात शोध चालु होता. अशा कामांना आर्थिक मदत तर लागतेच. भारतीचे म्हणणे आहे की नर्मदामैय्या करवून घेत आहे, दर महिना काही ना काही होऊन आजवर गेला आहे यापुढेही होईल. 

आर्थिक मदत मिळाली तर हवीच आहे मात्र अजुन एक मदत हवी आहे ती म्हणजे या मुलांना कपडे नाहीत. स्वच्छ, चांगले, सुती कपडे मिळावेत. पैसा, कपडे, खेळणी, धान्य हे तर प्रकल्पांना आवश्यकच आहे. पण अशा कामांना लागते ती माणसांची जोड. तिच्या बोलण्यात ती उणिव  जाणवत होती, माझ्यानंतर किंवा माझ्याबरोबर हा डोलारा कोण सांभाळेल, हा प्रश्र्न !  मी भारतीला म्हंटलं होते की माझ्या काही मित्र-मैत्रीँणीपर्यंत मी हे नक्की पोचवीन - ज्यांची क्षमता आहे शिकवण्याची, जे संवेदनशील आहेत, जे शिक्षणाचा मुलभूत विचार करतात, आपला किमान काही वेळ जे या मुलांना देतील, जमेल तितकी तुला साथ देतील – असे लोक !

तर जनांचा हा प्रवाह मी मध्यप्रदेशात लेपा गावापाशी नेऊन सोडत आहे...

How Guardian wrote Nehru's Death Story



 My friend and veteran journalist Mahesh Vijapurkar this morning emailed me a link of the following story of the Guardian, and asked my opinion about its language. (He has asked other senior journalists also.)

I emailed him my response as follows:


"As you are aware, I am currently obsessed with Plain and Simple language for newspaper writing. I checked the readability of the news text. The two tests for readability indicated that this story could be understood by an 8th-grade student in a US school. 
There are no difficult words. Clauses are absent. The lead and paragraphs are written taught in the  textbooks of the media schools. 
 I wish all of us Indian journalists use such simple language."

Jawaharlal Nehru, Prime Minister of India, is dead. At 2 p.m. local time today 460,000,000 people in this country that has been forged on the anvil of this one man's dreams and conflicts were plunged into the nightmare world which they have, in the last decade, come to dread as the "after Nehru" era.
At 6.25 a.m. today Mr Nehru, who had gone to sleep last night "fresh and fit" after his short holiday at a hill station, had a stroke. He lost consciousness almost immediately, but not before he had complained to his valet of a pain in the back. He died without regaining consciousness, and according to a member of his household, his death was due to "an internal haemorrhage, a paralytic stroke, and a heart attack."
His daughter, Mrs Indira Gandhi, had sent immediately for the three doctors who had been attending Mr Nehru since his last stroke some six months ago. They tried everything but failed.
Parliament, which had reassembled this morning for a special seven day session, had been told that the Prime Minister was sinking. MPs heard the news of his death at 2.05 p.m. During question hour Mr Nehru was to have replied to a series of questions about Kashmir and Sheikh Abdullah. Mr Gulzarilal Nanda, the Minister of Home Affairs, is taking charge of the caretaker Cabinet. There is to be a Cabinet meeting tomorrow morning. Mr Nanda is the most senior of the Ministers.
At about 4.00 this afternoon after the MPs and the Cabinet Ministers, the Congressmen and the Socialists and the Communists, the Hindus, the Sikhs and the Moslems, had gone in by a side door of the Prime Minister's house, I was allowed to see the body. My shoes joined the others outside, silent witnesses to a sacred moment.
I walked into a house laden with the smell of burning sandalwood sticks, softly past nameless white men in khadi into the bedroom in which he lay.
It was a white wake that was being kept in the bedroom on the first floor. One's first instinct was not to look at Mr Nehru but at the people around him.
After five minutes one dared to see him. No, the face was not waxen. No, the face was not sad. No, the face was not in pain. No, the face was not that of an old man.
The face was frozen into a mould of bewildered determination. In death as in life this was a face not of repose but of eager, impatient discovery.
One walked out to let in the diplomatists, the MPs, the Sikhs and the Hindus and the Moslems. They came - but they did not weep. Instead, the eyes shifted, there were tremors of disbelief, tinctured with moments of illumination as if this had to happen, and then the eyes shifted again. This time with fear.
Fear was the one dominant feeling one experienced as one came out. Fear that at this moment one had to avoid the reality of Nehru's death and the Pandora's box of suppressed ambitions it will release.
The funeral procession tomorrow will cover six miles. Mr Nehru will be cremated at Raj Ghat, where Gandhi was cremated. The last rites for this agnostic will be administered by Hindu priests.

New Delhi:


Upholding the constitutional validity of criminal defamation provisions in the IPC drafted during the colonial era, the Supreme Court on Friday said these do not muzzle free speech and asked FULL COVERAGE: P 17 politicians Rahul Gandhi, Subramanian Swamy and Arvind Kejriwal and others to face trial for alleged statements harming others' reputation.
Bigger the stature of a person making the defamatory statement, the graver the of fence, the court said. “Position of the persons making the imputation would regulate the standard of care and caution,“ it said as it favoured retention of criminal defamation as an option to redress hurt caused to the reputation of a complainant.
“Right to free speech cannot mean that a citizen can defame the other. Protection of reputation is a fundamental right. It is also a human right,“ the court said. Cumulatively , it (the defamation laws) serves social inter est... Each is entitled to digni ty of person and of reputation. Nobody has a right to denigrate others' right to person or reputation,“ a bench of Justices Dipak Misra and P C Pant said in its 267page judgment rejecting arguments that criminal defamation was a legal tool to silence free speech. The petitioners had said these provisions had a chilling effect on their fundamental right to free speech and expression guaranteed under Article 19 of the Constitution.
During pendency of the peti tions challenging the validity of criminal defamation provisions, the SC had stayed all proceedings in trial courts. The bench said the stay on proceedings would continue for another eight weeks to facilitate the petitioners to move high courts concerned to challenge the trial court summons issued to them.
However, if before approaching the apex court, any of them had already failed in the HC in challenging the summons, “he shall face trial and put forth his defence in accordance with law“, the bench clarified.
Writing the judgment for the bench, elucidating on concepts of free speech, democracy , dignity and reputation of individuals and referring to foreign case laws, Justice Misra said, “It is extremely difficult to subscribe to the view that criminal defamation has a chilling effect on the freedom of speech and expression.“ The court said reputation of a person was intrinsic to most precious right to life guaranteed under Article 21and for its protection, Parliament has kept intact Sections 499 and 500 of IPC.

`Could Be Used To Stifle Free Speech'
Former attorney general Soli J Sorabjee and ex-solicitor general Harish Salve were disappointed with the Supreme Court's judgment on Friday upholding the constitutional validity of criminal defamation provisions in Sections 499 and 500 of Indian Penal Code.
Sorabjee said, “It is a rather disappointing judgment. Defamation does not have to be a criminal offence. It can be misused to stifle free speech. Imposing heavy damages for harm to reputation is the right remedy .“
Salve said the court could have at least nuanced the application of criminal defamation provisions, which were being increasingly used to harass persons. “It should also be laid down how and when truth can be a robust defence in criminal defamations.“
In a lighter vein, he said he would love to take a second crack at the constitutional validity of criminal defamation proceedings at an appropriate time in future.

State’s duty is to protect reputation, says apex court ruling on batch of petitions by BJP leader Subramanian Swamy, Congress vice-president Rahul Gandhi, Delhi Chief Minister Arvind Kejriwal and media associations, among others.
In a judgment that holds far-reaching implications for political dissent and a free press, the Supreme Court on Friday upheld a colonial and pre-Constitutional law criminalising defamation.
The 268-page verdict dismissed apprehensions, raised by personalities across the political spectrum and media organisations championing the fundamental right under Article 19 (1) (a) of the Constitution, that criminal defamation may have a chilling effect on the freedom to circulate one’s independent view and “not to join in a chorus or sing the same song.”
The judgment came on a batch of petitions filed by BJP leader Subramanian Swamy, Congress vice-president Rahul Gandhi, Delhi Chief Minister Arvind Kejriwal, and media associations, among others.
The court refused exhortations that penalisation of defamation is past its time, and the nation now risks the danger of being reduced to a “frozen democracy.”
A Bench of Justices Dipak Misra and P.C. Pant said the reputation of an individual was an equally important right and stood on the same pedestal as free speech. The court said it would be a stretch to say that upholding criminal defamation in modern times would amount to imposition of silence.
Place for dissent
“Mutual respect is the fulcrum of fraternity that assures dignity. It does not mean that there cannot be dissent. It does not convey that all should join the chorus or sing the same song. Indubitably not. One has a right to freedom of speech and expression. One is also required to maintain the idea of fraternity that assures the dignity of the individual,” said Justice Misra, who authored the verdict.
The court held that criminalisation of defamation to protect individual dignity of life and reputation is a “reasonable restriction” on the fundamental right of free speech and expression. “The right to reputation is a constituent of Article 21 of the Constitution. It is an individual’s fundamental right,” Justice Misra observed.
'Defamation, a crime against society'
The Supreme Court which upheld the criminal defamation law on Friday held that deliberate injury to the reputation of an individual is not a mere private wrong, worth only a civil case for damages.
Instead, it is a “crime” committed against society at large and the State has a duty to redress the hurt caused to its citizen’s dignity. “Nobody has a right to denigrate others’ right to person or reputation,” the Bench of Justices Dipak Misra and P.C. Pant said.
Thus, Sections 499 and 500 of Lord Macaulay’s Indian Penal Code of 1860, which prescribes two years’ imprisonment for a person found guilty of defamation won the court’s approbation. It said though free speech is a “highly valued and cherished right”, imprisonment is a proportionate punishment for defamatory remarks.
“Interest of the people involved in the acts of expression should be looked at not only from the perspective of the speaker but also the place at which he speaks, the scenario, the audience, the reaction of the publication, the purpose of the speech and the forum in which the citizen exercises his freedom of speech and expression,” Justice Misra reasoned.
The petitioners facing criminal defamation trial have been given eight weeks to approach the High Courts concerned under Article 226 and Section 482 of the Cr.PC to quash the proceedings against them. For this purpose, the apex court has stayed the criminal proceedings against them for eight weeks.
